OLMSTEAD (WCCO) — A 25-year-old Rochester man has been charged Wednesday in the death of a baby, according to the Olmstead County Court.

Michael Roy Smith faces a maximum sentence of 40 years in prison after being charged with second-degree murder without intent while committing a felony.

Police say Michael Roy Smith of Rochester had been residing with the 4-month-old baby boy’s 21-year-old mother and a 30-year-old man at a home on the 500 block of 36th Street Southwest.

According to court papers, Michael Roy Smith shared a room with the child. He told police he came home from a Super Bowl party early Monday morning and tried to go to bed, but the baby started crying. That’s when he said he picked him up and threw him back into the crib. He also admitted to shaking him and hitting him on the chest.

    I hope he gets at least half of that max.40 year sentence but seeing how this is Minnesota he will probably only do a couple years and be out of prison in 18 months due to good behavior, sick, sick, sick

    Another thing I don’t understand is why was he sharing a bedroom with the child and not the mother or father.

    The guy that killed the baby was not even the father, was he?

    The guy was sharing a room with mother and child but at the time this happened the mother had been outsode smoking she didnt see the risk because when she had checked her son had been sleeping!

    I think he’ll get 25 to 30 years. I don’t understand why this poor baby was made to sleep in a room with a tenant, friend, or whatever. The mother should be held accountable to some extent, since we don’t know who the father is. If it’s the guy in the story, they both need to be fixed.

    I actually grew up with Mike and he never seemed like the kind of guy who would do something like this. I think he should get the whole 40 years as far as I am concerned, and I was his friend since I was 16 years old.

      Mike is not that kind of person . i think this was just an accident . I grew up with him. Bartley u should not judge it so quickly we all do mistakes in our life . I hope they will go a little easy on him . he had a rough life.

        Apparently Mike is “That Kind of Person.” I just don’t understand how putting a pillow over the sweet baby’s face, shaking the baby and throwing the dear child back into the crib from 3 feet away is an accident.?? Sorry Mike had a rough life but at least he got a chance at life. Baby Aiden’s life was cut short and didn’t get a chance. RIP Sweet sweet baby…

      James, I think that you should have gone with your instincts of knowing Mike all of his life and Knowing that he would have never done this. My brother will be found inocent because he is. It is already coming out that he did not do this. I hope you feel stupid for not trusting your instincts on a life long friend and abandoning him at the drop of a hat!!     I think what we need more of in Minnesota is Baby Killer Killers. If this child had been a relative of mine – this guy would not live long enough to spend 1 week in jail

      Maybe the mom needs to come to the reality that is should be marriage first, then baby, then happy family. But our society has it so backwards. Who know how many guys she has in her life based upon this story?

    I am mikes sister there is so much more to this story i will only say he was interigated for over 11 hours and was unable to call family or a lawyer please people dont believe what u here there is alot of holes in this story i can say alot more but i would be writing forever.

    To billy, please get your facts straight this is a mans life at stake and your on here talking out of your ass.. knowhere did it sayanything about the mom being out smoking and if she told u that then she lied to u or she lied to the investigators so u saying things like that is not helping lisa at all.

    As a mother of two kids, one who is two weeks older then aiden the baby who was killed find it disturbing that in his obituary she wrote survived by a loving mother. A loving mother doesnt sit in the other room playing video games while her boyfriend is in there hurting her son. You cant tell me she didnt hear him crying. And knowing her boyfriend was drunk. That is neglect to me and she deserves to go to jail as well. I think this all could have been prevented. When he wouldnt stop crying why wouldnt he just go get her. The whole situation makes me sick and breaks my heart. I didnt know any of them but, me and my family visit aidens grave and we are putting on a fundraiser this summer to buy new playground equipment and to name a park after him. I just want to raise awareness on child neglect and abuse and make sure aiden is never forgotten. Wheather or not it was an accident they both need to pay for what they have done. I hope the mother lives knowing every day she could and should have protected her son but failed to do so. God bless aiden and may he rest in peace.

      That’s such a great idea to name a park after Aiden. He will be remembered. My twin babies were 4 months old at the time this happened and I couldn’t imagine inflicting any sort of pain to them. Helpless little baby. Ughhhh. Just sick to my stomach. It’s been almost 3 months and this is still getting to me.
