Rochester Man Charged In Baby's Death

OLMSTEAD (WCCO) -- A 25-year-old Rochester man has been charged Wednesday in the death of a baby, according to the Olmstead County Court.

Michael Roy Smith faces a maximum sentence of 40 years in prison after being charged with second-degree murder without intent while committing a felony.

Police say Michael Roy Smith of Rochester had been residing with the 4-month-old baby boy's 21-year-old mother and a 30-year-old man at a home on the 500 block of 36th Street Southwest.

According to court papers, Michael Roy Smith shared a room with the child. He told police he came home from a Super Bowl party early Monday morning and tried to go to bed, but the baby started crying. That's when he said he picked him up and threw him back into the crib. He also admitted to shaking him and hitting him on the chest.
