BRAINERD, Minn. (AP) — A jury has convicted a 68-year-old man who was driving a van that struck and killed a 3-year-old boy in Merrifield two years ago.

Jurors on Wednesday found Sherman Frederick of Crosslake guilty of criminal vehicular homicide.

The Brainerd Dispatch reports Frederick also was found guilty on a lesser charge of careless driving.

Authorities say Frederick drove on the right shoulder to get around cars that were waiting for several children to cross a road in May 2009. That’s when authorities say he struck and killed Jack Larson of Buffalo, who was visiting his grandparents for Mother’s Day weekend.

The defense argued that Frederick has medical issues — he suffers from sleep apnea and diabetes — that may have led to the crash.

    Was there a crosswalk? Why do they leave out information?

    I think some of the defense attorney’s should be charged with purgury for making uop such lies about why an accident occured. He was probably in a hurry and irritated he had to stop, not realizing there were children present he flew around the other cars and in the process hit one of the kids. Attorney’s who fabricate such far out reason for why people do things should be held accountable.

    Just look at how the defense is trying to get Casey Anthony off the hook. Unbelievable that it is ok for an attorney to flat out lie trying to defend someone.

    This is a very busy road. Across the street is a park. Patience is necessary when drivng through Merrifield. Sounds like a case of a gentleman that was lacking patience and made a very careless decision. Don’t play the health issue…….

    I think he should have got life, there is way too many drivers in this state who use the shoulder to pass illegaly, this is going to keep happining until the legislature puts some teeth in the fines for anyone doing this. Such as losing your lic for 30 days instead of a $25 fine

    There was 3 kids crossing the road. There was no cross walk.the speed limit is 35 mph where it happened. There was cars stopped going north and south to let the kids cross the road this guy drove around on he shoulder and then hit the little boy. Very sad!

    I feel so bad for everyone. I am sure if there was dirty on the guy it would have been brought to light. From the sounds of it no one can say the man was bad or good. It is a shame his life is ruined now and his mistake may haunt him forever. Dont let the mugshot mislead you -jail isnt the best place to take a picture.

    Poor baby boy (the 3 year old) so cute and his life cut unnecessarily short! I pray and hope his family are released from turmoil and what has to be hell. Nothing replenishes life that is lost, nothing. My heart goes out to them.

    Such a bad situation.
