MINNEAPOLIS (WCCO) — A 23-year-old Burnsville man pleaded guilty on Tuesday to second-degree manslaughter in connection with the shooting death of Justin James Schauer on Dec. 31, 2011.
The sentencing date for Kyle Alan Dague is set for 9:30 a.m. on Nov. 30 in Hastings.
According to the charges, police arrived on the scene where Schauer had died of his injuries. Dague said he and Schauer had been playing a game with a 9 mm handgun, trying to catch the ejected bullet in the air with their free hand.
Dague had said he wasn’t looking when he heard the gun go off and that Schauer must have shot himself with the weapon.
The investigation found that Dague’s DNA was on the handgun, but not Schauer’s. Police said witnesses said they’ve seen Dague point the gun toward others and pull the trigger without bullets in the gun on multiple occasions.
Another witness said Dague had said he was the one who shot Schauer on the night of Schauer’s death.
