ST. PAUL, Minn. (AP) — A prosecutor says a man plotted to kill another man who was trying to sell a car on Craigslist, but his defense attorney says the shooting was accidental.

Testimony in the trial of 20-year-old Dao Xiong started Friday.

Xiong, of Oakdale, is accused of killing 33-year-old Youa Ty Lor on Sept. 9 in Lake Elmo and stealing his car.

Assistant Washington County Attorney John Fristik said the motivation was a Nissan 350Z that Lor advertised on Craigslist.

The St. Paul Pioneer Press reports two days before the killing, Xiong sent a text to a friend, asking him if he wanted to help kill a guy.

His defense lawyer F. Clayton Tyler says the gun was meant to scare Lor but it went off accidentally.

Xiong’s trial continues Monday.

    UhOh!! Gun accidently fired itself while pointed at victims head during a pre-meditaed robbery…Better aquitt the minority defendant.

    I think it’s an open and shut case: why the hell bring a firearm with you to buy a car? It’s like taking a gun into a bank to ask for a “loan”. Gimme a break! The seller wouldn’t be dead from an accidental gun shot wound if the gun wasn’t along, right? Dumb defense.
