WAUKESHA, Wis. (AP) — A jury has convicted a Waukesha County man of fatally kicking his pet dog in front of his children.

Jurors on Monday found 54-year-old Michael Tessmer of the town of Oconomowoc guilty of causing mental harm to a child and mistreatment of animals, causing death.

The Milwaukee Journal Sentinel reports Tessmer faces up to nine years in prison when he is sentenced May 9.

Tessmer was accused of kicking the dog 10 times on Feb. 28, 2009. The 3-year-old dog, named Zorro, died the next day.

According to the complaint, Tessmer became angry when he returned home with the children and found the dog had urinated and defecated on the floor.

The defense contended that Tessmer never intended to kill the dog.

    Anger management needed here, but the jail time…if he did the same to a human he wouldn’t get that much time.

      It get’s really annoying when every news story about a crime or criminal prosecution includes the maximum sentence as “could get up to x years”. He will probably get a year sentence, 335 days stayed $385 in fines and court fees, 30 days in jail with credit for time served (maybe time off for good behavior), a year of probation and yes… anger management. He can still work under Huber and the family may get a couple peaceful weekends.

      The problem is that the “man” of the house has a short fuse and a problem with self control of his violent actions.

      Anger management could be a few dingy sessions with someone fresh out of college who doesn’t understand why all children can’t live the sheltered life they lived in middle-class suburban utopia.

      Hopefully there can be a no-nonsense approach to domestic abuse with an experienced social worker or PO who can read through the BS and hold the whole family accountable.

    he suppose to kick the dog died at the sence because dog not follow his direction. he teach the dog not to urinate on the floor but dog not listen to him. this is the way we train animal to be a good and understand to human

      What the he!! are you talking about? You leave an animal alone without a way to get outside and what do you think is going to happen if you don’t come back to let it out? Sounds like another person needs to have their animals taken away before this happens again.

    Animal Crulity is something that needs to be stongly dealt with and stiffer punishments need to be applied to ANYONE who causes undue harm or even death to a defensless animal. I grew up watching my pets being severely abused over and over again by my family member,and there is nothing more heartbreaking than to witnes something SO terrible and being too young to do anything about it. Does this cause mental distress to a child or children, INDEED it does, it’s something you NEVER forget! I feel that the punishment should fit the crime! As an adult ,you should know better and set a better example for your child or children and treat ALL life with respect!

    I think we’re all agreed it’s a horrible, sick thing to do, especially in front of kids. The guy has issues big time. But nine years? That’s ridiculous. Maybe 30 or 90 days to teach the guy a lesson. I think the animal rights crowd must be driving this one.

      I truely agree that 9 years is somewhat F’D,but just remember,what goes around,comes around.NOMATTER WHO<OR WHAT,children ALWAYS need their daddy,but that daddy needs to be true about how to treat others.9 years is way to messed,they don't give childrapist,or grandma beaters that long,take daddy to the pound and show him what animals go thru just to be loved.Teach him to feel their pain and struggle just to survive.JUST TO BE LOVED.

    That’s just ridiculous. He kills an animal and 9 years is the punishment for this? Pretty sad that it has come to be like that. And every time any person sets a bad example in front of a child, whether intentional or not, are we just gonna throw them in jail for a couple years? Punish the guy, but be realistic about it.

      Wow you need to get your head checked. Nobody kicks an animal to death and calls it “a bad example”. It is called cruel and unusual punishment that will spill over to the children 1 day. So your idea is to slap him on the wrist, and then 1 day his kid wets their pants and then gets kicked to death. Is that another “bad example you idiot?

        What if and what could have are irrelevant, The punishment is based on what he did not what he might do could have done.
        Using those rules if he was a great guy and saved a child from a burning building before this the punishment should be less?

        Punishment, absolutely but, I’m not will to foot the bill to keep the guy locked up for 9 years.

    I think he should get a lengthy sentence of working at an animal shelter, closely supervised, of course. There he might learn to appreciate animals and the shelter could definitely use the help.

    As one who has worked in an in-patient hospital with survivors of abuse, it is clear to me that the actions of this demented man, was to demonstrate to his children exactly what could happen to them in case they decided to defy “dad.”. Often the abuser will preface these type of actions to their children with, “this is what will happen to you.”. Harming an animal after the child has bonded closely with an animal is used particularly in order to keep boy victims silent.

    If he kicked my dog and killed him he’d better start running because I will put a bullet in his head. Most dogs are better than most people. At least you know what your dealing with when you deal with a dog.
