MINNEAPOLIS (WCCO) – Amy Senser’s attorney filed a formal appeal on Wednesday in connection with Senser’s conviction in the hit-and-run death of a Minneapolis chef.

Senser, the wife of former Viking and restaurateur Joe Senser, was sentenced to 41 months in prison for two counts of criminal vehicular homicide in the death of 38-year-old Anousone Phanthavong.

In the appeal brief, her attorney, Eric Nelson, argues to the Minnesota Court of Appeals that there was insufficient evidence to sustain Senser’s criminal convictions, and that “errors of law and abuses of discretion” occurred in the trial’s proceeding, making it unfair.

Nelson is calling for the criminal vehicular homicide convictions to be reversed and that Senser’s case be remanded for a new trial.

Senser struck Phanthavong in August of 2011 on a highway exit ramp near the restaurant where he worked.
