49-Year-Old Indicted In Fatal Winona Drive-By Shooting

MINNEAPOLIS (AP) -- A Winona County grand jury has returned a first-degree murder indictment against a Winona man accused in a drive-by shooting that killed one man and injured another.

KAGE reports 49-year-old Ricky Darnell Waiters was indicted on murder and attempted murder in the first-degree in connection with the shooting last July behind EB's Corner bar. The indictment also includes six other felony counts.

Fifty-three-year-old Robert Charles Johnson was killed and 27-year-old Sean Patrick O'Brien was injured. Waiters is being held on $5 million dollars bond. Police say they recovered a handgun at Waiter's residence after the shooting and six spent 40-caliber shell casings inside his vehicle.

If convicted, Waiters faces a sentence of life in prison.
